By accessing or using the ForgeAI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including visitors, registered users, and customers.

ForgeAI reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

ForgeAI provides an AI-powered marketing automation platform that enables users to create content, manage campaigns, capture leads, analyze performance, and automate marketing workflows. The Service is provided on a subscription basis.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information remains accurate and up to date

You must be at least 18 years old to create an account. Accounts may not be shared or transferred without our written consent.

Plans: ForgeAI offers Starter ($99/mo), Professional ($499/mo), and Enterprise ($1,999+/mo) subscription plans. Plan details and features are described on our Pricing page.

Billing: Subscriptions are billed monthly or annually in advance. All fees are non-refundable except as provided in our 14-Day Money-Back Guarantee.

14-Day Money-Back Guarantee: If you are not satisfied with the Service, you may request a full refund within 14 days of your initial subscription purchase. This guarantee applies to first-time subscribers only.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of the paid period.

Price Changes: We may change subscription prices with 30 days' notice. Continued use after the price change constitutes acceptance.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Send spam, unsolicited emails, or violate CAN-SPAM, GDPR, or similar laws
• Transmit malware, viruses, or harmful code
• Infringe intellectual property rights of any third party
• Collect or harvest personal data without proper consent

Violation of these terms may result in immediate termination of your account without refund.

Our IP: The Service, including all software, algorithms, designs, text, and graphics, is owned by ForgeAI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Your Content: You retain ownership of all content you create or upload to the Service ("User Content"). By using the Service, you grant ForgeAI a limited license to host, display, and process your User Content solely to provide the Service.

Feedback: Any feedback or suggestions you provide may be used by ForgeAI without obligation or compensation to you.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining necessary consents from your contacts and customers.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FORGEAI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORGEAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO FORGEAI IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless ForgeAI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in San Diego County, California.
